The Supreme Court on Friday dismissed an interlocutory injunction application filed by Ofoase-Ayirebi Member of Parliament (MP) Kojo Oppong Nkrumah seeking to stop selected criminal trials from proceeding during Ghana’s ongoing legal vacation.
Justice Gabriel Pwamang, sitting as a single judge, ruled that Hon. Oppong Nkrumah had not established a sufficiently strong case to warrant the injunction.
The decision clears the way for selected High Court criminal trials to continue under administrative warrants issued by Chief Justice Paul Baffoe-Bonnie. The legal vacation runs from August 1 to September 30.
Oppong Nkrumah had challenged the constitutionality of the Chief Justice’s decision to assign certain judges to hear criminal cases during the vacation, arguing that the arrangement raised constitutional concerns, including equality and non-discrimination under Article 17.
However, the Supreme Court’s dismissal of the injunction does not determine the substantive constitutional case, which remains pending.
Meanwhile, Hon. Oppong Nkrumah has also indicated that he may seek a review of the Supreme Court’s decision. Enditem
