Ghana’s Supreme Court delivered a significant judgment in the long-running electoral dispute over the Kpandai parliamentary seat on Wednesday.
By a 4–1 majority, the apex court quashed the Tamale High Court decision that had annulled the 2024 election results and ordered a rerun. In doing so, it restored Matthew Nyindam as the duly elected Member of Parliament for Kpandai.
The High Court in Tamale had previously annulled Nyindam’s election following a petition by National Democratic Congress (NDC) candidate Daniel Nsala Wakpal and ordered a rerun, which the Electoral Commission scheduled for late December 2025.
Nyindam however challenged that ruling at the Supreme Court, arguing that the High Court lacked jurisdiction because the election petition was filed outside the constitutionally mandated 21-day period after the results were gazetted.
The Supreme Court agreed with this argument, finding that the High Court had erred and thus set aside its judgment. As a result, the planned rerun was halted and Nyindam’s parliamentary status was restored.
The decision was made by a panel of five Supreme Court justices.
Majority: Justices Yonny Kulendi, Amadu Tanko, Samuel Kwame Adibu Asiedu, and Henry Kwofie with Justice Gabriel Scott Pwamang dissenting.
The court’s full written judgment is expected to be published on 6 February 2026.
Matthew Nyindam thanked the Supreme Court, his legal team, party leadership, and supporters for their role in the outcome, saying the ruling reaffirmed “the will of the people of Kpandai.”
The decision brings finality to months of political uncertainty in the constituency and confirms Nyindam’s role in Parliament through the remainder of the term. Enditem
