The Office of the Special Prosecutor (OSP) on Tuesday reiterated that former Finance Minister Ken Ofori-Atta remains a fugitive from justice in Ghana, insisting that recent developments in a United States immigration court do not alter his legal status in Ghana.
The OSP was responding to media reports suggesting that a U.S. immigration court had found there was no credible evidence of wrongdoing against Ofori-Atta.
The Office rejected that interpretation, stating it was not a party to the U.S. immigration case and that any findings in those proceedings do not determine the validity of criminal allegations before Ghanaian courts.
According to the statement the OSP said the former Finance Minister is still required to submit himself to the jurisdiction of the High Court in Accra to answer pending criminal charges and that the proceedings in a U.S. immigration court are separate from Ghana’s criminal case and have no bearing on the OSP’s investigations or prosecution.
The OSP further stated that the extradition request filed by Ghana through the Attorney-General is distinct from the U.S. immigration proceedings and remains in place and that criminal proceedings against Ofori-Atta will continue in accordance with Ghanaian law, whether or not he is physically present in the country.
